Circular No. 157/13/2021-GST dated 20 July 2021 · 2021-07-20

CBIC explained the effect of the Supreme Court's order of 27 April 2021 extending limitation. The extension applies where an appeal has to be filed against a quasi-judicial order before the Joint or Additional Commissioner (Appeals), the Commissioner (Appeals), the Appellate Authority for Advance Ruling, the Tribunal or the courts, or where a revision or rectification of an order has to be sought. It does not apply to proceedings a taxpayer has to initiate or compliances he has to make, which remain governed only by the statute and by the notifications issued under section 168A of the CGST Act, nor to the quasi-judicial work of officers such as deciding refund claims, revocation applications and demand adjudications, which may continue.

This notification fixed the rates of interest under the CGST Act. Interest on delayed payment of tax under section 50(1) is eighteen per cent per annum. Interest where credit is taken in excess or output liability is reduced in excess under section 50(3) is twenty four per cent per annum. Interest on delayed refunds under section 56 is six per cent per annum, rising to nine per cent where the refund arises from an appellate order.

What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. Can one invoice contain items taxed at different GST rates?
