Owing to a mistake, the company's GSTR-3B for one month was filed showing nil figures even though the tax had actually been paid, and the portal offered no way to correct it. The department refused rectification. The High Court held that a taxpayer cannot be left without a remedy for a bona fide error where the tax was in fact paid and no revenue was lost, and directed the authorities to allow the correction so that the liability and the recipient's credit were properly reflected.
What to do about it: A genuine reporting error in GSTR-3B is worth pressing before the department rather than absorbing — courts have ordered correction where no tax was actually short paid.

This notification specifies the categories of services under section 9(3) on which the whole of the tax is payable by the recipient rather than the supplier. The original list covers goods transport agency services, legal services by an individual advocate or firm of advocates, arbitral tribunal services, sponsorship, most services supplied by the Central or State Government or a local authority, services of a director to a company, insurance agent services, recovery agent services and certain transport and copyright services. GSTN Advisory dated 24 September 2024 — archival of GST returns data older than seven years · 2024-09-24
GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. Taxpayers were advised to download and preserve their returns and supporting data before the archival date for each period.
What to do about it: Download and store PDF and JSON copies of every GSTR-1, GSTR-3B and GSTR-9 filed since 2017, because archived returns cannot be retrieved from the portal during an audit or appeal.
