49th GST Council Meeting, New Delhi — 18 February 2023 · 2023-02-18
The 49th GST Council meeting decided to clear the entire balance of GST compensation dues to states, with the Centre releasing Rs 16,982 crore for June 2022 from its own resources pending cess collections. The Council also approved release of admissible final compensation to states that had furnished revenue figures certified by their Accountant General. This closed the five-year compensation window promised to states at the launch of GST, while cess collections continued to service the back-to-back loans taken during COVID.

Achampet Solar Pvt Ltd — AAAR Telangana, Order No. AAAR.COM/04/2022, dated 19 October 2022 (setting aside AAR Order No. 07/2022, dated 16 February 2022) · 2022-10-19
The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.

Notification No. 47/2019-Central Tax dated 09.10.2019 · 2019-10-09
This notification made the filing of the annual return in FORM GSTR-9 optional for registered persons whose aggregate turnover in a financial year did not exceed Rs 2 crore, for the financial years 2017-18 and 2018-19. It further provided that where such a person did not furnish the return before the due date, the annual return would be deemed to have been furnished on that date. The relief was later extended to subsequent years by separate notifications.
Why this matters: A small Chennai business that never filed GSTR-9 for FY 2017-18 or FY 2018-19 is not in default, because the return is deemed furnished.
