This was given effect through the proviso to Section 50(1) inserted by the Finance Act, 2021 and notified retrospectively, and it neutralised thousands of interest demands raised on gross turnover across the country.

GSTR-3A is a system-generated default notice issued under Section 46 when you fail to file a return such as GSTR-3B. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. The department has provisionally attached my bank account under Section 83. What does that mean?

Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
How many days do I get to reply to an ASMT-10 notice?
The reply in Form ASMT-11 must be filed within thirty days of being informed of the discrepancies, or within such further time as the officer permits. If you need more time to gather reconciliations, write to the officer seeking an extension before the deadline instead of staying silent. The thirty days pass quickly because a proper reply needs invoice-level matching of GSTR-1, GSTR-3B, GSTR-2B and your books, so start compiling data the day the notice arrives. What is the difference between a Section 73 and a Section 74 notice?

What GST rate applies to cars and two-wheelers now?
Small cars, meaning petrol cars up to 1200cc and diesel cars up to 1500cc with length not exceeding 4 metres, attract 18 percent GST, down sharply from the earlier 28 percent plus cess. Larger cars, SUVs above these specifications, attract the 40 percent rate, but with the compensation cess gone, the overall burden on most of them is still lower than before. Motorcycles up to 350cc are at 18 percent, while those above 350cc attract 40 percent. Electric vehicles continue at a concessional 5 percent. How do I document free samples and gifts given to customers?
Goods supplied genuinely free of cost to unrelated persons are not a supply, so no tax invoice is raised and no GST is charged; the movement is covered by a delivery challan marked as free samples. The cost is that input tax credit on those goods must be reversed. Two traps deserve care: gifts to related persons or between distinct GSTINs of the same PAN are taxable under Schedule I even without consideration, and promotional schemes like buy one get one are treated as a single price for two items, taxed normally with credit intact. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register.
