The Supreme Court held that misstatement or suppression of facts must be wilful and coupled with an intent to evade payment of duty before the extended period of limitation can be invoked. An innocent or inadvertent error, even if it results in short payment, does not attract the extended period. The department must establish the mental element, and it cannot be presumed from the mere existence of a short payment.

The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.

CBIC notified 31 March 2025 as the last date for paying the tax demanded in Section 73 notices, statements or orders for FY 2017-18, 2018-19 and 2019-20 to earn the full waiver of interest and penalty under Section 128A. Where a matter was originally raised under Section 74 and is redetermined under Section 73 on appellate or court direction, payment is allowed within six months of the redetermination order.
