The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.

Practical effect: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

Cancer drugs cut to 5 per cent; namkeens and savoury snacks cut to 12 per cent

The Council reduced GST on three cancer drugs — Trastuzumab Deruxtecan, Osimertinib and Durvalumab — from 12 per cent to 5 per cent. Extruded or expanded savoury snacks and namkeens were cut from 18 per cent to 12 per cent prospectively, aligning them with similar ready-to-eat namkeens, while un-fried snack pellets stayed at 5 per cent. The Council also brought roof-mounted package unit (RMPU) air conditioning machines for railways under 28 per cent and moved car seats from 18 per cent to 28 per cent.

The GST rate on my product changed. Which rate applies to pending orders and invoices?
Section 14 of the CGST Act decides this by looking at three events: the date of supply, the date of invoice and the date of payment. Broadly, if any two of the three events fall after the rate change, the new rate applies; if two fall before, the old rate applies. So goods delivered in Pammal before 22 September 2025 but invoiced and paid for afterwards attract the new rate, while goods delivered and invoiced earlier keep the old rate even if payment came later.
