Issued with the tobacco rate notification, this reduces the compensation cess rate to nil on pan masala, tobacco and the related products that had continued to bear cess after September 2025, with effect from 1 February 2026. Since the goods simultaneously moved to the forty per cent GST rate, the combined burden is broadly preserved while the cess itself is retired, bringing the compensation cess levy introduced in July 2017 to an end for practical purposes.
Practical effect: From 1 February 2026 no compensation cess is charged on any goods, so cess columns in invoices, returns and accounting software should be closed out.

The department provisionally attached the taxpayer's bank accounts and stock under Section 83 during an investigation. The High Court laid down that provisional attachment is a drastic and extraordinary power to be used sparingly and only on the basis of tangible material showing it is necessary to protect revenue. Attachment cannot be ordered mechanically or as a matter of course, and a cash-credit account, being a borrowing facility rather than the taxpayer's property, cannot be attached.
What it means for you: An attachment of your current account or cash-credit limit during an enquiry can be challenged if the officer has not recorded material justifying it.
Achampet Solar Pvt Ltd — AAAR Telangana, Order No. AAAR.COM/04/2022, dated 19 October 2022 (setting aside AAR Order No. 07/2022, dated 16 February 2022) · 2022-10-19
The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.
Practical effect: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.
