The Karnataka High Court held that collection of tax during investigation without assessment or self-ascertainment offends Article 265, found the payments involuntary in the circumstances, and directed the department to consider refund; a Division Bench affirmed the taxpayer-protective reasoning on threat and coercion.
Why this matters: Document the timeline and circumstances of any payment made during an investigation — midnight or pre-adjudication payments can be reclaimed as involuntary deposits.

GSTN removed the requirement to select a refund period in chronological order for certain refund categories, so a claim need not follow strict sequence, and moved those categories to invoice-based filing. For export of services with payment of tax, supplies to special economic zone units with payment of tax, and deemed export claims by the supplier, the applicant uploads the specific invoices in the relevant statement and those invoices are then locked against a repeat claim. All returns due up to the date of the claim must be filed.
Practical effect: Keep returns current and your export invoice register clean, since refunds are now claimed invoice by invoice and each invoice can be used only once.

Schedule III carries twenty per cent central tax, that is forty per cent combined, and is deliberately short. It covers aerated waters and other beverages containing added sugar or sweetening matter, caffeinated beverages, carbonated beverages of fruit drink, larger motor cars and hybrids above the small-car limits, motorcycles above 350 cc, aircraft for personal use, yachts and pleasure vessels, revolvers and pistols, smoking pipes and cigarette holders, and specified actionable claims such as betting, casinos, lottery and online money gaming.
What it means for you: Only a narrow list attracts forty per cent, so a supplier pushed into that slab by an officer should check whether the goods actually appear in Schedule III.
