CBIC prescribed a mechanism to claim it under the residual category 'Any other' in Form RFD-01, supported by the relevant documents, pending a dedicated category on the portal.

This notification laid down the conditions and safeguards for furnishing a Letter of Undertaking instead of a bond for export of goods or services without payment of integrated tax. In its original form the LUT facility was restricted, being available broadly to status holders and to exporters who had received a specified minimum of foreign inward remittances against exports. All other exporters had to execute a bond with a bank guarantee.
Why this matters: This is the restrictive starting point that Chennai exporters complained about, and it was liberalised within three months by Notification 37/2017-Central Tax.

The petitioner challenged a provisional attachment of its bank account. By the time the matter was heard, one year had elapsed from the date of the order. The Court observed that orders of attachment under Section 83 are self-limiting and remain in force for one year only, after which nothing survives for adjudication. The writ petition was accordingly closed, the attachment having ceased to operate by force of the statute itself.
What to do about it: A Chennai business should diarise the date of any Section 83 attachment — after twelve months the bank must release the account, and a fresh order is required if the department wants to continue.
