56th GST Council Meeting, New Delhi — 3 September 2025 · 2025-09-03
The 56th GST Council meeting approved the biggest structural reform since 2017, replacing the 5, 12, 18 and 28 per cent slabs with a two-rate structure — a 5 per cent merit rate and an 18 per cent standard rate — plus a 40 per cent de-merit rate for a narrow set of luxury and sin goods. Most items at 12 per cent moved to 5 per cent and most at 28 per cent moved to 18 per cent. The new rates took effect from 22 September 2025 and remain in force.
Practical effect: Every Chennai business had to re-map product rates, reprice stock and update billing software from 22 September 2025 — rate mistakes since then invite scrutiny notices.
Greenwood Owners Association v. Union of India — Madras High Court, 2021 · 2021-07-01
Resident welfare associations challenged the CBIC circular and AAR view that once monthly maintenance exceeds Rs 7,500 per member, GST applies on the entire amount. The Madras High Court held that the exemption operates up to Rs 7,500, and only the amount in excess of that threshold is taxable — the term 'up to' marks a clear slab. The circular's contrary interpretation was quashed as contrary to the exemption notification.
Practical effect: Chennai apartment associations collecting over Rs 7,500 per month per flat should charge GST only on the excess over Rs 7,500, relying on this jurisdictional ruling.

Three clarifications were given. From 1 January 2021 the date of the debit note, and not the date of the underlying invoice, determines the financial year for the time limit in section 16(4), so credit on an old invoice can still be taken through a later debit note. Where an invoice carries an Invoice Reference Number under the e-invoicing system, the transporter need not carry a physical copy. The bar on refund of unutilised credit applies only to goods actually subjected to export duty.
Why this matters: This restored credit on debit notes for earlier years and removed the need to carry paper invoices once e-invoicing is in place.
