56th GST Council Meeting, New Delhi — 3 September 2025 · 2025-09-03
The 56th GST Council meeting approved the biggest structural reform since 2017, replacing the 5, 12, 18 and 28 per cent slabs with a two-rate structure — a 5 per cent merit rate and an 18 per cent standard rate — plus a 40 per cent de-merit rate for a narrow set of luxury and sin goods. Most items at 12 per cent moved to 5 per cent and most at 28 per cent moved to 18 per cent. The new rates took effect from 22 September 2025 and remain in force.

The Supreme Court held that refund of indirect taxes must ordinarily be claimed through the machinery provided in the taxing statute and within the limitation prescribed there. Crucially, it held that a refund cannot be granted where the claimant has passed on the tax burden to the buyer, as that would result in unjust enrichment. The claimant must prove that the incidence of tax was borne by him.

Many taxpayers paid confirmed demands through Form DRC-03 rather than through the payment option against the demand order, so the amount was never adjusted in the electronic liability register and the demand continued to show as outstanding, exposing them to recovery action. Rule 142(2B) and Form GST DRC-03A were introduced to allow such payments to be linked with the relevant demand order, and GSTN enabled the form on the portal in November 2024.
What it means for you: If you settled a GST demand through DRC-03, file DRC-03A at once so the liability register closes and no recovery notice follows.
