The Council approved in principle four draft GST Rules covering Input Tax Credit, Valuation, Transitional Provisions and Composition, and approved the amended versions of five rules already cleared earlier, namely Registration, Return, Payment, Refund, and Invoice and Debit or Credit Note. The rules were to be circulated to the States and placed in the public domain for comment before final approval, which is how the CGST Rules, 2017 took the shape businesses work with today.

CBIC modified paragraph 41 of the master refund circular so that the recipient of deemed export supplies is no longer barred from availing input tax credit on the invoices for which he claims refund, since the portal in any case requires him to debit an equal amount from the credit ledger. It also extended the relaxation for exporters who wrongly declared zero-rated supplies in Table 3.1(a) of GSTR-3B instead of Table 3.1(b), and clarified that the cap introduced by Notification No. 16/2020-Central Tax, which limits the turnover of zero-rated supply of goods to 1.5 times the value of like goods supplied domestically, applies equally when computing adjusted total turnover in the denominator of the rule 89(4) refund formula.

The Supreme Court read down the ITC block in Section 17(5)(d) CGST Act for construction of immovable property. It held that the phrase 'plant or machinery' differs from the defined 'plant and machinery', and whether a building qualifies as a 'plant' must be decided case by case using a functionality test — for example, a shopping mall built essentially to supply renting services could qualify, allowing input tax credit on its construction.
What to do about it: Chennai businesses constructing malls, warehouses or commercial premises for leasing should evaluate ITC claims under the functionality test, but must factor in the 2025 retrospective amendment substituting 'plant and machinery' before relying on this ruling.
