This notification replaced the old declared tariff test for accommodation with the value of supply actually charged. From 1 October 2019 accommodation up to one thousand rupees per unit per day was exempt, above that and up to seven thousand five hundred rupees attracted 12 per cent, and above seven thousand five hundred rupees attracted 18 per cent. It also reduced outdoor catering at premises other than specified premises to 5 per cent without credit and rationalised several job work entries.
Practical effect: Chennai hotels and lodges must apply the rate to the amount actually billed after discount, not to the rack rate printed at the reception.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.
What to do about it: Chennai beverage makers must check whether the drink is carbonated before applying the 12 percent fruit drink rate.

The department had communicated the show cause notice only to the taxpayer's email address and never furnished it physically, with the result that the taxpayer remained unaware of the proceedings and no personal hearing took place. The Court held that this fell short of Section 75(4) and of natural justice, set aside the order, and remanded the matter on condition that the petitioner pay 25 per cent of the disputed tax and file objections, after which a proper notice and hearing must be given.
