The Supreme Court held that the value of goods supplied free of cost by a service recipient to the contractor, such as cement and steel provided by the client, cannot be added to the gross amount charged for the service. Tax can be levied only on the consideration actually received by the service provider. Amounts that never form part of the contractor's billing are outside the scope of the charge.
What to do about it: A Chennai contractor receiving free-issue materials from the client should not include their value in the GST taxable value, but must document the arrangement in the contract.

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.
Why this matters: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.

The Council recommended nil GST on food preparation of millet flour in powder form containing at least 70 per cent millets by weight when sold loose, and 5 per cent when pre-packaged and labelled. GST on molasses was slashed from 28 per cent to 5 per cent to benefit sugarcane farmers and reduce cattle feed costs. The Council also clarified that job work services of converting barley into malt attract the concessional 5 per cent rate applicable to job work in relation to food products, and not 18 per cent.
What to do about it: Food processors and cattle-feed traders in Tamil Nadu gained significant input cost relief and needed to re-price millet-based products.
