Trade Profile and GST Jurisdiction for Valasaravakkam

Finding dependable DRC-01/DRC-01A Demand Reply in Valasaravakkam usually means choosing between a distant online portal and an overloaded local accountant. Valasaravakkam has shifted from farmland to apartment blocks, and promoters, interior contractors and building material suppliers now work alongside supermarkets and clinics on Arcot Road and in Alwarthirunagar. Works contract taxation drives most disputes here: the 18 per cent rate on contract services, blocked input credit on construction under Section 17(5) and GSTR-7 TDS where contracts involve government bodies. We offer a third option: a professional Chennai GST practice that treats Valasaravakkam, Virugambakkam and Alwarthirunagar as home ground, responds the same working day, files ahead of deadlines, and stands behind its work if a notice ever arrives on a return we prepared.

GST jurisdiction for Valasaravakkam (PIN 600087): businesses here generally fall under the CGST Chennai South Commissionerate. We regularly represent clients from Valasaravakkam before this jurisdiction for registrations, clarifications and notice hearings, and can confirm your exact division and range from your GSTIN. State-jurisdiction cases are handled with the Tamil Nadu Commercial Taxes Department.
GST for IT and SaaS Companies in Valasaravakkam
IT and SaaS services are taxed at 18 percent domestically, but the real complexity is qualifying overseas billing as export under Section 2(6) of the IGST Act: the recipient must be outside India, consideration must arrive in convertible foreign exchange or INR where RBI permits, and the Indian entity and foreign recipient must not be mere establishments of the same person. Marketing or support arms serving a foreign parent risk classification as intermediaries under Section 13(8), making the place of supply India and the income taxable. Supplies to SEZ units are zero-rated with proper endorsements. A specialist structures contracts and invoicing so export status survives departmental scrutiny.
For DRC-01/DRC-01A Demand Reply in Valasaravakkam, you typically need your PAN, Aadhaar, business address proof, bank details and relevant invoices; the exact checklist is shared on WhatsApp and fees start at Rs.4,999.
Why Us

Why Valasaravakkam Businesses Choose ChennaiGST

Not a bulk-filing portal. A senior consultant knows your file, your jurisdiction and your deadlines.

✓

Notice-Proof Filing Discipline

Most GST notices trace back to mismatches between GSTR-1, GSTR-3B and GSTR-2B. We reconcile these before filing, not after a notice arrives, so your returns are internally consistent and the most common triggers for ASMT-10 scrutiny simply never appear.

✓

Correct HSN Codes and Rates, Verified

GSTR-1 requires four-digit HSN reporting for turnover up to Rs.5 crore and six digits above it, and a wrong code often means a wrong rate. We verify the classification of what you actually supply, so your invoices and returns rest on defensible codes.

✓

Cancelled GSTIN? We Handle Revocation Too

A registration cancelled for non-filing is not the end of the road. We bring the pending returns up to date, clear the dues and file the revocation application in REG-21 within the permitted window, restoring suspended and cancelled GSTINs to active status.

✓

E-Commerce Seller Reconciliation, Including TCS

Sellers on Amazon, Flipkart and other marketplaces face a three-way match between marketplace reports, GSTR-1 and the TCS the operator deposits against your GSTIN. We reconcile all three every period and accept the TCS credit, so sellers in Valasaravakkam never leave marketplace deductions unclaimed.

✓

No Handing Off to Untrained Juniors

Your work is executed by trained GST staff working under direct senior supervision, not passed to interns learning on your file. The person preparing your return understands reverse charge, blocked credits and place of supply, because getting these wrong costs you money.

✓

Waiver and Amnesty Windows Applied for You

Whenever the GST Council notifies a late-fee waiver or an amnesty window for pending returns or old demands, we check every client's history against it and act within the deadline. Relief that businesses in Valasaravakkam would otherwise read about after it lapsed reaches our clients in time.

How It Works

Our Demand Reply Process

Demand analysis

We examine whether the notice is under Section 73 or 74, check the limitation period, and break the demand into issues that can be defended separately.

Merits assessment

Each issue is tested against your records, GSTR-2B and case law, and we give you a candid view of what is defensible and what is genuinely payable.

DRC-06 reply drafting

A detailed statutory reply is drafted in Form DRC-06 with reconciliations, invoices and legal grounds, shared for your approval and filed on the portal in time.

Hearing and payment strategy

We represent you at the personal hearing. For any admitted liability we file DRC-03 promptly, using the concessional closure available under Section 73 where applicable.

Order and next steps

We track the adjudication outcome, review any order in DRC-07, and advise on rectification or appeal in APL-01 within three months if the demand is confirmed.

Why a Specialist Matters

With ChennaiGST vs Doing It Yourself

AspectWith ChennaiGSTDIY / Unattended
Portal credentials and dataLogins handled by a small engaged team under strict confidentiality, with credentials stored securely and never passed onward.Passwords circulating on chats with freelancers and part-timers, and no accountability for who has accessed your business data.
Supplier defaultsSuppliers who stop uploading invoices are identified within the period and pursued before their default becomes your blocked credit.Missing supplier invoices surface only when credit is denied, by which time recovering the amount from the vendor is difficult.
Late fees and interestFilings go in ahead of statutory dates, so the Rs.50-per-day late fee and 18 percent interest never arise.Late fees accumulate silently every delayed day, and interest on unpaid tax runs at 18 percent per annum.
Refund claimsRFD-01 filed with complete statements and annexures, tracked from ARN to bank credit, with any deficiency memo answered promptly.Incomplete claims bounce back as deficiency memos while the refund sits unclaimed for months and working capital stays blocked.
Time costRoughly an hour a month to send data and approve drafts; the portal work, reconciliation and follow-up are ours.Hours every month lost to portal errors, JSON files, OTP failures and reworking figures — usually on the due date itself.
Registration and amendmentsQuery-resistant applications prepared correctly the first time, with supporting documents matched to what proper officers actually verify.Repeated clarification memos and resubmissions, with weeks lost because a rent agreement or premises photograph did not meet expectations.

Case Law

A single show cause notice cannot club several financial years together

M/s. NSV Labour Contractor v. Assistant Commissioner (Central Tax) — Madras High Court, W.P. Nos. 16753, 16758 and 16761 of 2024, decided 21 August 2025 (Krishnan Ramasamy J.) · 2025-08-21

The department issued consolidated show cause notices covering 2017-18 to 2022-23. The Madras High Court held that clubbing more than one financial year in a single notice is impermissible and that notices must be issued separately for each tax period, and disposed of two of the petitions accordingly. The third petition, which challenged an ASMT-10 scrutiny notice on GSTR-1 versus GSTR-3B differences, was dismissed with liberty to reply within four weeks.

How we apply it: If you have received one omnibus DRC-01 covering several years, the clubbing itself is a strong preliminary objection worth raising in your reply.

Notification

Cement down from 28 to 18 per cent

Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, Schedule II, heading 2523 · 2025-09-17

Portland cement, aluminous cement, slag cement, super sulphate cement and similar hydraulic cements, whether or not coloured or in the form of clinkers, appear in Schedule II at nine per cent central tax, giving a combined eighteen per cent from 22 September 2025. Cement had carried twenty-eight per cent since 2017 and was the single largest tax input in construction. Marble, granite and most other building materials also sit at eighteen per cent in the same schedule.

What to do about it: Builders and hardware dealers in Chennai must bill cement at eighteen per cent and should have revisited running contracts and price lists from 22 September 2025.

Circular

Liquidated damages, notice pay and contractual penalties are generally outside GST

Circular No. 178/10/2022-GST · 2022-08-03

This is the leading circular on the agreeing to tolerate an act entry. The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.

What to do about it: Chennai employers and contractors should resist departmental demands on notice pay recovery and liquidated damages by citing this circular in the reply itself.

Free Tool

Already Holding the Notice? Read It in About a Minute

Upload the PDF to our free GST Notice Analyser. It identifies which of 34 notice types you have, pulls out the DIN, GSTIN and tax period, reads the reply date printed on the notice and tells you plainly whether that date has already passed — along with the documents and reconciliations you will need. No payment, no account. If the notice does not state a date we can read, it says so rather than guessing one for you.

Analyse my notice — free WhatsApp it to a consultant

The analyser reports what your notice says and the statutory position for that form. It is not a substitute for a consultant reading your actual records, and a reply should be reviewed before you file it.

FAQs

Frequently Asked Questions

Straight answers from practising GST consultants — based on the CGST Act, current CBIC notifications and day-to-day portal experience.

Are there any hidden charges for DRC-01/DRC-01A demand reply?
No. The fee quoted before we start is the fee you pay. Government fees, portal charges or statutory late fees, where they apply, are separate and disclosed to you in advance with the exact amount. We issue a proper GST invoice for our professional fee. If the scope of work changes — for example, an unexpected notice or additional periods — we tell you the revised fee before doing anything further.
What documents are required for DRC-01/DRC-01A demand reply in Valasaravakkam?
For DRC-01/DRC-01A demand reply you will generally need: Copy of DRC-01 or DRC-01A with annexures, GST portal login credentials, GSTR-1, GSTR-3B and GSTR-9 copies for the disputed periods, GSTR-2A and GSTR-2B data for the disputed periods, Purchase invoices and supplier ledger for ITC disputes. The exact list depends on your constitution — proprietorship, partnership, LLP or company — and on the specifics of your case. Send what you have on WhatsApp to +91 - 9600 606 444 and we will confirm within the same working day exactly what else is needed, so nothing is rejected later for a missing paper.
Can the penalty in a Section 74 fraud case be reduced by paying early?
Yes, Section 74 has a built-in incentive to settle early. If you pay the tax and interest before the show cause notice is issued, the penalty is 15 percent of the tax. If you pay within thirty days of the notice, penalty is 25 percent and the proceedings conclude. Even after the order, paying within thirty days limits penalty to 50 percent instead of 100 percent. Payments are made in DRC-03 with the correct cause selected. Whether to settle or contest depends on the strength of the fraud allegation, so have the notice evaluated professionally before choosing; call +91 - 9600 606 444 for an assessment.
What is Form DRC-03 and when should I use it?
DRC-03 is the form for making a voluntary payment of tax, interest or penalty on the GST portal, either before a show cause notice is issued or within thirty days of receiving one. It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. Select the correct cause of payment and period in the form, because a wrongly mapped DRC-03 creates reconciliation trouble later.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. Do not let the appeal window lapse; call +91 - 9600 606 444 for an urgent review of the order.
Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Verify the computation, pay only what is truly due, and contest the balance in Part B with reasons. ChennaiGST routinely trims DRC-01A figures for clients before payment.
I received a DRC-01 notice for ITC mismatch between GSTR-3B and GSTR-2A. How do I defend it?
Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Valasaravakkam cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. Where a supplier has genuinely defaulted, quantify and pay only that portion through DRC-03 rather than conceding the entire demand.
What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Valasaravakkam as urgent.
Who can help me reply to a GST scrutiny notice near me?
Look for a practitioner who handles scrutiny replies regularly, not just return filing, because an ASMT-11 stands or falls on the quality of its reconciliations. ChennaiGST assists businesses in Valasaravakkam and across Chennai with the complete cycle: reading the ASMT-10, extracting the portal data, matching GSTR-1, GSTR-3B, GSTR-2B and books, drafting the reply, paying any admitted amount in DRC-03 and following up until the ASMT-12 closure order. Fees start at Rs.4,999 depending on the number of discrepancy points. Share the notice on +91 - 9600 606 444 and we will confirm the scope and timeline the same day.
Which educational services are actually exempt from GST?
The exemption is confined to an educational institution as defined, meaning one providing pre-school education, education up to higher secondary school or equivalent, education as part of a curriculum for obtaining a qualification recognised by Indian law, or an approved vocational education course. Services by such institutions to their students, and specified input services to schools such as transport, catering and security, are exempt. Everything outside this boundary is taxable: private tuition, test preparation, hobby classes, skill courses without recognised certification, and training by ed-tech companies. The recognition of the qualification under Indian law is the decisive test, not the subject taught.
Is a pure labour contract for building a house exempt from GST?
Two exemptions exist for pure labour contracts, meaning contracts where the contractor supplies only labour and the owner buys all materials. First, construction, erection or installation of original works pertaining to a single residential unit, otherwise than as part of a residential complex, is exempt. Second, pure labour services under the Pradhan Mantri Awas Yojana for beneficiary-led individual house construction are exempt. Outside these, labour contracts are taxable at 18 percent. A mason team building one independent house in Valasaravakkam on labour-only terms therefore charges no GST, but the same team working on an apartment project must.
What is the electronic liability register on the GST portal and why should I check it?
The electronic liability register, maintained in Form PMT-01, records every liability raised against your GSTIN: self-assessed tax from returns in Part I, and demands from assessments, adjudication orders and DRC-07 summaries in Part II. Payments and pre-deposits are set off against these entries. You can view it under Services, then Ledgers. Checking Part II periodically matters because demand entries you never noticed can trigger recovery, interest accumulation and refund adjustments. During any refund claim, the officer will offset outstanding register balances, so a clean register speeds up your money. We review all three ledgers in every Valasaravakkam health check.
Is GST charged before or after the discount shown on my invoice?
Discounts given before or at the time of supply and recorded on the face of the invoice are excluded from the value of supply under Section 15(3)(a). You therefore charge GST on the net amount after discount. For example, a Rs.10,000 item with a 10 percent trade discount shown on the invoice is taxed on Rs.9,000. The condition is documentation: the discount must appear on the invoice itself. Informal reductions settled outside the bill do not reduce taxable value. Retail schemes such as festival discounts and trade margins should always be structured to print on the invoice.
Why is my e-way bill generation blocked on the portal?
Under Rule 138E, the e-way bill facility is blocked when a taxpayer has not filed GSTR-3B (or CMP-08 for composition dealers) for two or more consecutive tax periods. Since an e-way bill is mandatory for moving goods worth more than Rs.50,000, blocking effectively halts dispatches. The remedy is straightforward: file the pending returns with late fee and interest, after which the facility unblocks automatically, usually the next day. Transporters and suppliers can also be affected when a counterparty GSTIN is blocked. We clear return backlogs for businesses in Valasaravakkam on priority; call +91 - 9600 606 444.
Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC. Companies in Valasaravakkam should split their director payments ledger accordingly, issue self-invoices for the RCM portion, and keep board resolutions and TDS treatment consistent as supporting evidence.
Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register. Multi-state businesses headquartered in Valasaravakkam use this to shift idle deposits to the branch that actually needs the cash, avoiding fresh working capital outflow.
Do you provide drc 01 notice reply for small businesses and proprietorships in Valasaravakkam?
Yes. A large share of our clients in Valasaravakkam are proprietors, small traders, shop owners, freelancers and family businesses rather than large companies. The fee of Rs.4,999 and the process are the same regardless of size, and we explain the compliance position in plain language — in Tamil or English — so you understand what is being filed on your behalf and why.
How much does DRC-01/DRC-01A demand reply cost in Valasaravakkam?
Our fee for DRC-01/DRC-01A demand reply in Valasaravakkam starts at Rs.4,999 and is quoted in full before we begin — there are no hidden charges added later. The fee covers professional work end to end: document review, preparation, filing and follow-up until completion. Government fees or portal charges, where applicable, are separate and always shown to you upfront. For an exact quote based on your turnover and business type, call +91 - 9600 606 444 and a consultant will confirm it on the call.
What is the process for DRC-01/DRC-01A demand reply?
The process runs in clear stages: Demand analysis; Merits assessment; DRC-06 reply drafting; Hearing and payment strategy. A senior consultant reviews your file at each stage rather than passing it to a data-entry desk, and you receive a confirmation with the filed documents once it is complete. You always know which stage your work is at — we update you on WhatsApp instead of leaving you to follow up.
