The assessment orders had denied input tax credit purely because the returns were filed after the Section 16(4) cut-off. The Court held that the challenge was squarely covered by newly inserted Section 16(5), which permits credit on invoices relating to the financial years 2017-18 to 2020-21 if taken in any return filed up to 30 November 2021, notwithstanding Section 16(4). The impugned orders were quashed and the matter remitted for fresh orders consistent with the amendment.
Practical effect: A Chennai dealer whose ITC for 2017-18 to 2020-21 was disallowed only for late filing should apply for rectification or move the High Court, since Section 16(5) now protects that credit.

The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.
Why this matters: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.

The Council reduced the late fee for failure to furnish GSTR-1 covering supply details, GSTR-5 for non-resident taxable persons and GSTR-5A for OIDAR suppliers to Rs 50 per day, and to Rs 20 per day for nil filers. Late fee for failure to furnish GSTR-6 by an input service distributor was set at Rs 50 per day. This extended the nil-filer distinction created for GSTR-3B at the previous meeting across the rest of the return forms.
