Circular No. 109/28/2019-GST dated 22 July 2019 · 2019-07-22

CBIC clarified that maintenance charged by a resident welfare association is exempt where it does not exceed Rs 7,500 per member per month, a limit raised from Rs 5,000 with effect from 25 January 2018. An association is liable to register only if its annual turnover exceeds Rs 20 lakh and its charges exceed Rs 7,500. Where the limit is crossed, tax is payable on the entire amount and not merely the excess. A member owning two flats gets the limit separately for each, and the association can claim input tax credit.

What it means for you: Apartment associations across Chennai should test both the Rs 20 lakh turnover and the Rs 7,500 per-flat tests, and remember that crossing the limit taxes the whole amount.

Electronic toys attract 18 percent while other toys stay at 12 percent

Navbharat Imports - AAR Tamil Nadu, Advance Ruling No. 35/AAR/2021, dated 30 September 2021 · 2021-09-30

The importer sold a range of children's toys, some containing electronic circuits and some working purely mechanically. It asked for the correct rate on each. The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

Practical effect: Chennai toy traders must classify item by item, because a single electronic component moves a product from 12 to 18 percent.

QRMP scheme introduced: quarterly returns with monthly payment for turnover up to Rs 5 crore

42nd GST Council Meeting (video conferencing) — 5 October 2020 · 2020-10-05

The Council approved what became the Quarterly Return Monthly Payment scheme. Registered persons with aggregate annual turnover up to Rs 5 crore were allowed to furnish GSTR-3B on a quarterly basis from 1 January 2021, while paying tax monthly through a challan. The due date for the quarterly GSTR-1 was fixed at the 13th of the month following the quarter, and an invoice furnishing facility was provided so that recipients could still see credit monthly. This remains the default compliance route for most small businesses.

Practical effect: A Chennai business under Rs 5 crore can file GSTR-3B four times a year instead of twelve, but must still deposit tax every month, and missing that monthly challan attracts interest.

B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. Is there a late fee for filing GSTR-1 after the 11th?
Yes. Late fee for GSTR-1 is Rs.50 per day of delay, and Rs.20 per day where there are no outward supplies, subject to caps linked to your turnover. Although the portal historically collected GSTR-1 late fees through the next GSTR-3B, the liability arises the moment the due date passes. Delayed GSTR-1 also hurts your customers, because your invoices miss their GSTR-2B and their input tax credit gets deferred, which can strain business relationships. Filing by the 11th every month avoids both the cost and the friction.
Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again.
