CBIC clarified that under Rule 88B(3), interest under Section 50(3) arises only where wrongly availed input tax credit has actually been utilised. Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.
Practical effect: When reversing a disputed credit, extract the daily credit ledger balances, since a consistently adequate balance defeats the interest demand entirely.

The Supreme Court held that provisional attachment of bank accounts and property under Section 83 CGST Act is a draconian power that must be exercised strictly within statutory conditions: specified proceedings must be pending, the Commissioner must form an opinion on tangible material that attachment is necessary to protect revenue, and the order must be reasoned. Attachment cannot be a routine pressure tactic, and the Rule 159(5) objection procedure must be honoured.
Why this matters: If your bank account is provisionally attached by GST authorities, challenge defective orders promptly — courts will quash attachments made without recorded reasons or pending proceedings.
Notification No. 55/2020-Central Tax · 2020-06-27
This notification amended the earlier Section 168A notification and moved the outer date for compliances falling due between 20 March 2020 and 30 August 2020 to 31 August 2020. In substance it gave a further two months to complete any action, order, notice, appeal or application whose limitation had been frozen since the start of the lockdown. Officers as well as taxpayers took the benefit, so departmental orders passed up to that date remain valid.
