This circular settled four recurring questions. Perquisites provided by an employer to an employee under a contractual employment agreement are not liable to GST. The proviso to Section 17(5)(b) applies to the whole of that clause, so credit is available where a supply is obligatory under any law in force. The electronic credit ledger may be used to pay output tax, including tax demanded under Sections 73 and 74, but never for reverse charge liability, interest, penalty or fees.
What to do about it: Chennai employers can stop charging GST on contractual staff perquisites, but must always pay reverse charge tax, interest and penalty in cash even when the credit ledger has a large balance.
CBIC Instruction No. 04/2025-GST · 2025-05-02
To back up the registration processing instruction, CBIC required every CGST Zone to publicise a dedicated email address for registration grievances on its website and on the notice board of the concerned office. Applicants aggrieved by improper queries, unjustified rejection or delay may write to that address with the application reference number; the zone must examine the grievance, take corrective action and report the disposal to the Directorate General of GST periodically.
Practical effect: A registration rejected on flimsy grounds need not go straight to appeal; the zonal grievance email often gets the application reopened far faster.

Garments moving from Tirupur to Tuticorin for export were detained because the e-way bill showed Chennai as the place of dispatch, and a penalty equal to 200 per cent of tax was levied under Section 129(1)(a). The Court quashed the penalty, holding that the goods were in fact covered by documents, that the error was typographical and easily correctable, that Section 126 forbids penalty for such minor breaches absent fraudulent intent, and that leaving the reply column blank breached Section 129(4).
What to do about it: A Tamil Nadu exporter penalised for a clerical mistake in the e-way bill, with no allegation of evasion, has a strong case for refund of the penalty paid under protest.
