Section 11A empowers the Government, on the GST Council's recommendation, to notify that tax which was not levied or was short levied because of a generally prevalent trade practice need not be recovered. This gives statutory backing to the long-used device of regularising past periods on an 'as is where is' basis when a circular clarifies a disputed rate or classification, and protects taxpayers who followed the industry-wide understanding in good faith.
What to do about it: When a CBIC circular clarifies a rate you were charging differently, check whether the past period has been regularised before agreeing to pay any differential demand.

CBIC confirmed that the death of a sole proprietor, where the business is continued by the successor, is a transfer of business for the purposes of section 18(3), so the unutilised input tax credit can be transferred to the transferee through FORM GST ITC-02. The successor must first obtain a new registration, the cancellation application for the deceased's registration is filed selecting death of proprietor as the reason, and the transferee accepts the credit on the portal.
What it means for you: A family taking over a proprietorship after a bereavement need not lose the credit balance, provided the ITC-02 is filed before the old registration is cancelled.

At its very first meeting the Council debated exemption thresholds ranging from Rs 10 lakh to Rs 25 lakh and finally agreed that a business would not need GST registration until its aggregate turnover crossed Rs 20 lakh. For the eleven Special Category States listed in Article 279A of the Constitution, the threshold was set at Rs 10 lakh. The Chairperson recorded that the figure would be reviewed after five years, once the compensation guarantee to States had run its course.
What to do about it: The Rs 20 lakh figure that still governs whether a small Chennai service business must register was settled at this meeting and has been the starting point for every later threshold change.
