The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.

The Council recommended reducing the GST rate from 28 to 18 per cent on goods falling in 178 headings at the four-digit level, including four headings only partially pruned, so that the 28 per cent list fell from 224 tariff headings to only about 50. Further reductions were recommended from 28 to 12 per cent, from 18 to 12 per cent and from 18 to 5 per cent on specified goods, together with relief for the aviation and handicraft sectors and restaurants.

How are B2B and B2C invoices reported differently in GST returns?

Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Sholinganallur trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
How and when can I opt in or out of the QRMP scheme?

Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered.
