The applicant prepared food and served it in the canteens of client companies at their premises. It sought the rate applicable to this arrangement. The Authority held that the supply of food and beverages on the premises of an industrial undertaking was taxable at 18 percent up to 26 July 2018 and at 5 percent from 27 July 2018, when the restaurant service entry was amended to cover canteens at offices and factories, the concessional rate being available without input tax credit.
Practical effect: Chennai canteen contractors should bill factory and office canteens at 5 percent and forgo input tax credit on their purchases.
GSTN Advisory dated 23 August 2024 — introduction of the RCM Liability/ITC Statement · 2024-08-23
GSTN introduced a new RCM Liability and ITC Statement on the portal so that reverse charge tax declared in Table 3.1(d) of GSTR-3B can be matched against the corresponding credit claimed in Table 4A(2) and 4A(3). It applies from the August 2024 tax period for monthly filers and from the July to September 2024 quarter for taxpayers under the quarterly scheme. Taxpayers were required to report an opening balance of reverse charge liability paid but credit not yet claimed, or credit claimed without payment, within the window announced by GSTN.
Practical effect: Reconcile reverse charge payments with the credit taken every month, since the department can now see an RCM ledger for your GSTIN.
Notification No. 17/2021-Central Tax (Rate) dated 18.11.2021 · 2021-11-18
With effect from 1 January 2022, restaurant service supplied through an electronic commerce operator was notified under section 9(5) of the CGST Act. The operator, such as a food delivery platform, became liable to collect and pay the tax on those supplies instead of the restaurant, except where the restaurant is located in specified premises. The same notification also brought passenger transport by omnibus and certain motor vehicles supplied through an operator within section 9(5). Restaurants continue to report such supplies but do not pay tax on them.
Why this matters: A Chennai restaurant selling through a delivery app should show those sales separately in GSTR-3B as supplies on which the operator pays tax, and must not pay tax on them again.
