It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

Practical effect: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.

Circular No. 130/49/2019-GST dated 31.12.2019 · 2019-12-31

CBIC explained the scope of the reverse charge entry on renting of motor vehicles. It clarified that the entry applies where the supplier is any person other than a body corporate who pays tax at 5 per cent, supplies the service to a body corporate, and does not issue an invoice charging tax at 12 per cent with full input tax credit. Where the supplier is itself a body corporate, or charges 12 per cent, the recipient has no reverse charge liability.

The due date for the quarterly GSTR-1 was fixed at the 13th of the month following the quarter, and an invoice furnishing facility was provided so that recipients could still see credit monthly. This remains the default compliance route for most small businesses.

A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. How do I claim credit of the IGST paid on imported goods?
IGST paid at customs on imported goods is fully creditable, with the bill of entry serving as the prescribed duty-paying document instead of a tax invoice.
