Deciding a batch of petitions, the High Court held that Rule 86A permits an officer to disallow debit only of the input tax credit actually available in the electronic credit ledger on the date of the order. Creating an artificial negative balance so that credit accruing later is also blocked is impermissible. The Court emphasised that Rule 86A is a temporary protective measure and not a recovery tool, and therefore must be construed strictly.
Why this matters: Negative blocking of the credit ledger is now squarely disapproved — raise it immediately if your ledger is blocked for more than the balance you held.

The Board explained how demand and penalty apply where invoices are issued without any actual supply. A person who merely issues such an invoice has no output tax liability under Sections 73 or 74, because there is no supply at all, but is liable to penalty under Section 122(1)(ii). A person who takes and utilises credit on such an invoice faces demand and penalty under Section 74, and a person who further passes on that credit is treated the same way.
Practical effect: If your Chennai firm is alleged to have issued bill-only invoices, this circular is the basis for arguing that a tax demand cannot be raised on the issuer, only a penalty.

The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
Practical effect: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.
