CBIC explained the scope of the principal-agent relationship in Schedule I. The deciding test is the invoice: where the agent issues the invoice for the supply of goods in his own name, or receives goods in his own name from the supplier on behalf of the principal, the transaction between principal and agent is a deemed supply even without consideration. A commission agent who merely arranges a sale and never invoices the goods in his own name is not covered.
What it means for you: Commission agents in Chennai's wholesale markets should look at whose name appears on the invoice, since that single fact decides whether compulsory registration and deemed-supply tax apply.
Thai Mookambikaa Ladies Hostel v. Union of India — Madras High Court, W.P. No. 28486 of 2023, judgment dated 22 March 2024 (reversing the Tamil Nadu AAR) · 2024-03-22
The Tamil Nadu AAR held that hostel accommodation provided to college students and working women is not renting of a residential dwelling for use as residence, so the exemption did not apply and GST was payable. On writ, the Madras High Court reversed that view on 22 March 2024, holding that hostel rooms occupied by girl students and working women as their residence qualify for the exemption for renting of residential dwelling under Entry 12 of Notification No. 12/2017-Central Tax (Rate), and observing that the legislature never intended to burden such occupants with tax.
What it means for you: Hostel and PG operators in Tamil Nadu can rely on the Madras High Court ruling for exemption, but should document residential use of every room.
Kone Elevator India (P) Ltd v. State of Tamil Nadu — Supreme Court, Constitution Bench, (2014) 7 SCC 1, judgment dated 06-05-2014 · 2014-05-06
A five-judge Bench overruled the earlier view and held that a composite contract for manufacture, supply and installation of a lift is a works contract, because the lift comes into existence as a functional unit only on installation at site. The dominant nature test was rejected for contracts falling within the deemed sale of works contracts. The composite character of such contracts is now the basis of works contract taxation under GST.
Practical effect: Chennai contractors doing supply-plus-installation work should classify the transaction as a works contract service under GST rather than splitting it into goods and labour.
