The Authority held that toys containing electronic components attract 18 percent under the residual entry for electronic toys, irrespective of how those components are used, so children's scooters and smart tricycles with lights and music are taxed at 18 percent, while toys that work without electronics remain at 12 percent.

Further interest and late fee relief after the 40th Council meeting

Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24

This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.

Although the twelve per cent slab was otherwise removed, this standalone notification preserves it for the brick trade. From 22 September 2025 fly ash bricks, fly ash aggregates and fly ash blocks of heading 6815, bricks of fossil meals or similar siliceous earths of tariff item 6901 00 10, building bricks of tariff item 6904 10 00 and earthen or roofing tiles of tariff item 6905 10 00 attract six per cent central tax, that is twelve per cent combined.

What to do about it: A building material dealer in Chennai still bills bricks and roofing tiles at twelve per cent, not eighteen, and must not assume the GST 2.0 slab merger applied to them.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
Our institute charges one fee covering classes, study material and hostel. How is it taxed?
A single price for naturally bundled components is a composite supply, taxed at the rate of the principal supply. For a coaching institute, coaching is the principal supply, so the entire lump sum, including printed materials and boarding provided as part of the package, attracts 18 percent. Printing separate invoices for books at nil rate out of a bundled fee is a known audit red flag and is routinely rejected. If the institute genuinely sells optional printed books to anyone at a separate price, those standalone sales can take the book's own treatment. Structure the fee schedule deliberately, not after the demand arrives.
I received a debit note from a supplier for an old invoice. Which year's ITC deadline applies?
The deadline is counted from the date of the debit note, not the original invoice. After the Finance Act 2020 delinked debit notes from their underlying invoices, ITC on a debit note can be claimed up to 30 November following the end of the financial year in which the debit note itself was issued. So a debit note dated June 2025 against an invoice of January 2024 remains claimable until 30 November 2026. This delinking rescues many price-escalation and rate-difference credits that would otherwise appear time-barred, and it is worth checking before writing off any debit note credit as lost.
Can my company claim ITC on a car purchased for business use, and what about its insurance and repairs?
Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A St. Thomas Mount trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
I make both taxable and exempt supplies. How is the Rule 42 credit reversal actually computed?
