I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?

For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
I received an ASMT-10 scrutiny notice for my Surapet business. What exactly is it?
ASMT-10 is a notice issued under Section 61 after the officer scrutinises your filed returns and finds discrepancies, such as differences between GSTR-1 and GSTR-3B, excess ITC compared with GSTR-2B, or turnover gaps against e-way bill data. Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
How does GST work on lorry freight paid to a goods transport agency?
A goods transport agency, identified by its issue of a consignment note, is taxed in one of two ways. By default, specified recipients such as companies and registered persons pay 5 percent under reverse charge on the freight and can claim it as ITC. Alternatively, the GTA may opt to pay tax itself under forward charge, at 5 percent without ITC or 18 percent with ITC after the September 2025 rate rationalisation replaced the earlier 12 percent option, by filing the prescribed declaration for the financial year; the invoice should state this option. Transport by an individual lorry owner without a consignment note is not a GTA service and is exempt. Check each transporter's invoice wording before deciding who pays the tax.
How do I file Form PMT-09 to move money between heads in my cash ledger?
Log in and open Services, then Ledgers, then Electronic Cash Ledger, and select File GST PMT-09 for transfer of amount. The screen shows your balance under each major and minor head. Choose the transfer-from head and amount, choose the transfer-to head, add the details to the table, preview and file with DSC or EVC. The transfer reflects in the ledger immediately and an ARN is generated for your records. There is no limit on how often PMT-09 can be filed, and no government fee applies, so it is always the first fix for a wrong-head deposit.
What is the difference between a GST credit note and a commercial credit note?
A GST credit note is issued under Section 34, is reported in GSTR-1, and reduces your output tax, with the buyer reversing equivalent input credit. A commercial or financial credit note adjusts only the money owed between the parties; it carries no GST, is not reported in returns, and leaves everyone's tax position untouched.
