Delay in filing a reference or appeal beyond the period prescribed by the special statute cannot be condoned. The Tamil Nadu AAR held that hostel accommodation provided to college students and working women is not renting of a residential dwelling for use as residence, so the exemption did not apply and GST was payable. On writ, the Madras High Court reversed that view on 22 March 2024, holding that hostel rooms occupied by girl students and working women as their residence qualify for the exemption for renting of residential dwelling under Entry 12 of Notification No. 12/2017-Central Tax (Rate), and observing that the legislature never intended to burden such occupants with tax.
Why this matters: Hostel and PG operators in Tamil Nadu can rely on the Madras High Court ruling for exemption, but should document residential use of every room.

Meeting shortly after the Kerala floods, the Council discussed that State's proposal to impose a cess on SGST to fund rehabilitation and flood-related works. Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.
Practical effect: This process produced the Kerala flood cess of 2019, the only State-specific GST cess so far, and set the template for how any similar Tamil Nadu levy would have to be approved.
