It argued that these were only flours of cereals and pulses taxable at 5 percent. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.

The department demanded interest for delayed payment of tax and attached the taxpayer's bank account without first issuing any show cause notice. The High Court held that issuance of a show cause notice is a mandatory pre-condition before recovery of interest, because the taxpayer must have an opportunity to dispute the period and the computation. The recovery action and the bank attachment were quashed, with liberty to the department to proceed afresh after proper notice.
Practical effect: Interest cannot be lifted from your bank account without warning — insist on a show cause notice and a chance to verify the calculation.
