The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

What 'as is where is' regularisation in a GST circular actually means

Circular No. 236/30/2024-GST · 2024-10-11

CBIC explained the scope of the phrase 'regularised on as is where is basis' used when the Council settles a disputed rate or classification. Where taxpayers paid at the lower of two competing rates or claimed an exemption in good faith, the past position is accepted as full discharge and no differential demand arises. However, no refund is available to anyone who paid at the higher rate or did not claim the exemption, and the circular works through illustrations showing exactly which past positions stand closed.

Notification No. 7/2022-Central Tax (Rate), dated 13 July 2022 · 2022-07-13

This companion notification amended the exemption list so that the nil rate on cereals, pulses, flour and similar staples applies only where the goods are other than pre-packaged and labelled. Loose sale from an open sack or gunny bag remains exempt; the same commodity in a sealed retail pack bearing statutory declarations becomes taxable at five per cent. Both notifications came into force on 18 July 2022 and reshaped billing for every kirana and provision supplier.

I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. How much time does the GST department have to issue a demand under Section 73?
For a Section 73 demand, the adjudication order must be passed within three years from the due date of the annual return for the financial year concerned, and the show cause notice must be issued at least three months before that deadline. For Section 74 fraud cases, the order deadline is five years with the notice issued at least six months earlier. For tax periods from FY 2024-25 onwards, a new common provision in Section 74A applies with its own timelines. Start with a supplier-wise reconciliation identifying why each credit is missing from GSTR-2A, such as the supplier filing late, quoting a wrong GSTIN or reporting B2B supplies as B2C. For FY 2017-18 and 2018-19, CBIC Circular 183/15/2022 permits proving genuine credits through supplier certificates or CA certificates, which resolves many Thoraipakkam cases. Attach tax invoices, payment proofs and ledger extracts to your DRC-06 reply to establish that the conditions of Section 16 were met. You must file the pending return within fifteen days of the notice, along with the tax due, interest at 18 percent per annum and late fee of Rs.50 per day (Rs.20 per day for nil returns, both capped with reference to turnover). Once the return is filed within this window, no further action follows. If you have stopped business, apply for cancellation instead of leaving returns pending, because notices will keep coming every month.
Is GST payable on my YouTube AdSense earnings?
AdSense payments come from a Google entity located outside India and are remitted in convertible foreign exchange, so for an Indian creator this revenue generally qualifies as export of services, zero-rated when supplied under an LUT after registration. The income still counts towards your Rs.20 lakh aggregate turnover, so a creator whose combined receipts cross the threshold must register even if the entire revenue is export. Brand sponsorships from Indian companies, by contrast, are domestic supplies taxable at 18 percent. Keep the remittance advices safely, as they establish the forex receipt if you later claim a refund of input tax credit.
Should I claim a refund of my accumulated ITC or just carry it forward?
Carry-forward suits businesses whose future output tax will absorb the credit within a few months, since it avoids refund paperwork. A refund makes sense when the credit keeps growing and will never be absorbed, which is typical for exporters under LUT and businesses with inverted duty structure, because idle credit is interest-free money locked with the government. Remember that refunds are only available in categories permitted by Section 54; ordinary accumulated credit from slow sales cannot be refunded. A quick review of your credit ledger trend over six months usually makes the right answer obvious.
Can one invoice contain items taxed at different GST rates?
Yes, there is no requirement to issue separate invoices per rate. A single tax invoice can carry multiple line items, each with its own HSN code, taxable value, rate and tax amount, and the totals section simply aggregates the tax rate-wise. A hardware store in Thoraipakkam can bill cement at 18 percent and certain tools at 5 percent on one document. What matters is that each line is classified and taxed correctly, and that mixed baskets are not collapsed into one rate. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
Are any goods exempt from GST when transported by a GTA?
Yes. Transport by a GTA of agricultural produce, milk, salt and foodgrains including flours and pulses, organic manure, newspapers and magazines registered with the Registrar of Newspapers, relief materials for victims of calamities, and defence or military equipment is exempt regardless of freight value. Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
How is GST charged on hotel room tariffs after the rate changes?
Hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, a reduction from the earlier 12 percent. Rooms priced above Rs.7,500 per day attract 18 percent with full input tax credit. The rate is determined by the actual transaction value charged for the room, so seasonal discounts can change the applicable rate on the same room across bookings.
