The Council also extended the last date for opting into the six per cent service composition scheme in CMP-02 to 30 September 2019.

Nithiyashree Ladies Hostel - AAR Tamil Nadu, Advance Ruling No. 77/AAR/2023, dated 4 September 2023 · 2023-09-04

The applicant ran a ladies hostel in premises it had itself taken on rent and supplied accommodation together with food and related services. It sought exemption on the footing that this was renting of residential accommodation. The Authority held the supply classifiable under heading 9963 and taxable at 9 percent central tax and 9 percent State tax, treating hostel accommodation with attached services as a taxable service and not as renting of a residential dwelling for use as a residence.

How does a GTA opt for forward charge, and by when must it be done?

You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. A credit note relating to an invoice of a financial year must be declared in your returns by 30 November following the end of that financial year, or the date of filing the annual return, whichever is earlier. After this date, you can no longer reduce your output tax through a GST credit note for that year's invoices; any adjustment becomes purely commercial with no tax benefit. Yes. Send NIL space R1 space your GSTIN space tax period in MMYYYY format (use the quarter-ending month for quarterly filers) to 14409 from the registered mobile number of the authorised signatory. Confirm with the CNF code received, and the portal issues an ARN. A nil GSTR-1 is possible only when there are no outward supplies at all, including no credit notes, amendments or documents to report for that period. Is ITC available on food, catering and canteen expenses for our factory staff?
Section 17(5)(b) blocks credit on food, beverages and outdoor catering, but with two useful exceptions. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. The exemption attaches to the nature of the service, not the size of the hospital, so both a large corporate hospital and a single-doctor clinic are covered.
What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
Our small lodge in Thousand Lights gets bookings through online travel apps. Who pays the GST?
It depends on your registration status. If the lodge is registered, you charge GST on the accommodation and the platform collects TCS on payments routed through it, which you claim back on the portal. How is interest calculated on a GST demand or late payment?
Interest runs at 18 percent per annum under Section 50 on tax paid after the due date, computed day-wise from the day following the due date until payment. Following amendments, interest on delayed GSTR-3B liability applies on the portion paid through the electronic cash ledger, and interest on wrongly availed ITC arises where the credit has been both availed and utilised. Interest is payable even where no penalty applies, and it cannot be waived by the officer.
