Notification No. 13/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28
This notification specifies the categories of services under section 9(3) on which the whole of the tax is payable by the recipient rather than the supplier. The original list covers goods transport agency services, legal services by an individual advocate or firm of advocates, arbitral tribunal services, sponsorship, most services supplied by the Central or State Government or a local authority, services of a director to a company, insurance agent services, recovery agent services and certain transport and copyright services. Entries have been added over the years.
Why this matters: This is the working reverse charge checklist for a Chennai business, and lorry freight, advocate fees and director remuneration are the entries that most often go unreported.
LC Infra Projects (P) Ltd v. Union of India — Karnataka High Court, judgment dated 22 July 2019 · 2019-07-22
The department demanded interest for delayed payment of tax and attached the taxpayer's bank account without first issuing any show cause notice. The High Court held that issuance of a show cause notice is a mandatory pre-condition before recovery of interest, because the taxpayer must have an opportunity to dispute the period and the computation. The recovery action and the bank attachment were quashed, with liberty to the department to proceed afresh after proper notice.
Why this matters: Interest cannot be lifted from your bank account without warning — insist on a show cause notice and a chance to verify the calculation.
45th GST Council Meeting, Lucknow — 17 September 2021 · 2021-09-17
The Council decided that the rate changes needed to correct the inverted duty structure in the footwear and textiles sectors, discussed and deferred at an earlier meeting, would be implemented with effect from 1 January 2022. The correction involved moving fabrics, garments and footwear below the earlier value thresholds from 5 per cent up to 12 per cent so that output tax would exceed input tax and refund claims would cease. The Council also set up Groups of Ministers on rate rationalisation and on using technology to improve compliance.
How we apply it: Tamil Nadu's textile and footwear clusters faced a five to twelve per cent increase from January 2022, a decision the Council reversed for textiles on 31 December 2021, the eve of implementation.
