CBIC clarified that demo vehicles used by an authorised motor vehicle dealer to provide test drives and demonstrate features are used for making a further supply of such motor vehicles, so the blocking provision in Section 17(5)(a) does not apply and input tax credit is available. Credit is not available where the vehicle is used for staff transportation or other internal purposes, and dealers capitalising demo vehicles must not claim depreciation on the tax component.
Practical effect: Vehicle dealerships should claim input tax credit on demo cars used for test drives and reverse it only where the vehicle is diverted to internal use.

The High Court held that Section 74(5) merely gives the taxpayer an option to pay voluntarily; it does not empower officers to demand or coerce payment before a show cause notice. Raising a demand while the investigation is incomplete was held to be arbitrary and without jurisdiction, and refund of the amounts collected was directed.
