The applicant made polypropylene and recycled plastic trays used by farmers to raise paddy and vegetable seedlings, and argued that they were agricultural implements. The Authority held that the trays are other articles of plastic under heading 3926 90 99 and are taxable at 9 percent central tax and 9 percent State tax. Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.
What to do about it: Chennai suppliers to the farm sector cannot assume exemption merely because the buyer uses the product in agriculture.
32nd GST Council Meeting, New Delhi — 10 January 2019 · 2019-01-10
The Council created two threshold limits for exemption from registration and payment of GST for suppliers of goods, Rs 40 lakh and Rs 20 lakh, and gave states a week to choose which limit would apply in their territory. The threshold for service providers was left unchanged at Rs 20 lakh, and at Rs 10 lakh for special category states. The change was made operational from 1 April 2019 and remains the basic registration test for traders and manufacturers today.
What to do about it: A Chennai trader dealing only in goods crosses the registration line at Rs 40 lakh of aggregate turnover, but a service provider must register at Rs 20 lakh.
Circular No. 8/8/2017-GST dated 4 October 2017 · 2017-10-04
Following Notification No. 37/2017-Central Tax, this consolidated circular extended the Letter of Undertaking facility to every registered exporter of goods or services except a person prosecuted for a GST or earlier-law offence involving tax evasion above Rs 250 lakh. An LUT is valid for the financial year in which it is furnished. Exporters who are ineligible must give a bond with a bank guarantee of up to fifteen per cent of the bond amount. It replaced Circulars 2/2/2017, 4/4/2017 and 5/5/2017.
Practical effect: A Chennai exporter with a clean record can ship without paying IGST simply by filing an LUT each year, and need not block working capital in a bond or bank guarantee.
