Circular No. 124/43/2019-GST dated 18 November 2019 · 2019-11-18

Notification No. 47/2019-Central Tax made the annual return optional for registered persons with aggregate turnover below Rs 2 crore for the financial years 2017-18 and 2018-19. CBIC clarified that such a taxpayer who does not file FORM GSTR-9 by the due date will be deemed to have furnished it, and that a return filed after the due date will not be treated as deemed furnished. Taxpayers were nevertheless encouraged to file, since the return remains the vehicle for correcting reported figures.

This companion notification exempted intra-State supplies of listed goods from central tax altogether, covering fresh vegetables and fruit, unbranded cereals and pulses, milk, curd, salt, live animals, human blood, printed books, judicial stamp paper and many agricultural items. Suppliers dealing only in these goods make exempt supplies, cannot claim input tax credit on related purchases, and must reverse credit under Rule 42 where inputs are common. It was superseded with effect from 22 September 2025.

The Namakkal manufacturer made carbonated beverages containing fruit juice and sought classification under the fruit pulp or fruit juice based drinks entry taxed at 12 percent. The Authority held that once carbon dioxide is added the product is classifiable under heading 2202 10 as waters containing added carbon dioxide and flavouring, and not as fruit juice under heading 2009, so the higher rate applicable to that entry along with compensation cess applies. The Appellate Authority upheld that view.

Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.

Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. What documents do GST audit officers usually ask for?

It is commonly used to pay liabilities found during a self-review, to respond to a DRC-01A intimation, to settle audit findings, or to pay dues flagged in scrutiny. Paying through DRC-03 under Section 73 before the notice, along with interest, means no penalty and no notice on that amount. What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
Is GST applicable on rent for my shop or office premises?
Yes. Renting of commercial property such as shops, offices, godowns and industrial sheds is a taxable supply of services at 18 percent, charged by the landlord under forward charge once the landlord's aggregate turnover, including this rent, crosses Rs.20 lakh. What are OIDAR services under GST and who pays the tax on them?
OIDAR means Online Information Database Access or Retrieval services, delivered over the internet, such as cloud services, e-books, streaming, online advertising and automated e-learning. When a foreign OIDAR provider supplies these to unregistered persons in India, the foreign provider itself must take a simplified registration in Form REG-10 and file monthly return GSTR-5A. Which daily-use grocery items became cheaper under GST from September 2025?
The 56th GST Council's rationalisation, effective 22 September 2025, moved a large basket of daily essentials from 12% or 18% down to 5%, including butter, ghee, cheese, namkeens, sauces, pasta, chocolates, biscuits, cornflakes, hair oil, shampoo, soaps and toothpaste. UHT milk, pre-packaged paneer and all Indian breads such as roti, chapati and paratha became nil rated. Aerated and caffeinated beverages, by contrast, went to the 40% demerit rate. Grocery and supermarket billing masters needed a near-complete refresh from that date, and old stock is simply sold at the new rate applicable on the date of supply.
What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty.
