It held that the term goods covers all types of movable property, tangible or intangible, provided the item can be abstracted, transmitted, transferred, delivered, stored and possessed. A German company's liaison office in Tamil Nadu carried on only the representational and coordination activities permitted by the Reserve Bank of India and received funds from its head office to meet office expenses. The Authority held that liaison activities carried on strictly within the RBI permission do not amount to a supply under the CGST and TNGST Acts, the remittances from the head office are not consideration, and the liaison office is neither liable to pay GST nor required to register.
Practical effect: A genuine liaison office in Chennai doing only representational work stays outside GST, but any commercial activity changes that position.

The Aadhaar authentication requirements inserted earlier by the Eighth Amendment Rules had been left to take effect from a date to be notified. This notification appointed 1 January 2022 as that date, so that from the beginning of 2022 a refund application, a revocation application and an integrated tax refund on exports all became conditional on completed Aadhaar authentication and on a PAN-linked bank account. Applications filed without these steps are simply not processed on the portal.
What to do about it: From January 2022 onwards Aadhaar authentication is a gating requirement, so it should be completed at the registration stage rather than when a refund is urgently needed.
