Following the principal-agent circular, CBIC clarified the position of a del credere agent who guarantees payment by the buyer. Whether he is an agent under Schedule I again depends on whether he invoices the goods in his own name. Where he is not an agent and extends short-term credit to the buyer, the interest he charges is exempt as a supply of extending deposits or loans; where he is an agent, the interest forms part of the value of the supply of goods.
Practical effect: Agents who finance their buyers should document whether they invoice the goods themselves, since that determines whether the interest they collect is exempt or taxable.
Notification No. 11/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17
This notification amends the 2017 concessional rate notification for goods supplied to holders of petroleum exploration licences and coal-bed methane contracts, substituting the entry in the rate column with nine per cent central tax, that is eighteen per cent combined, with effect from 22 September 2025. The concessional scheme survives but at the standard rate, so the practical benefit is now limited to items that would otherwise attract a higher rate under the main schedule.
