The Supreme Court held that the expression suppression of facts, used to invoke an extended period of limitation, must be read in the context of the words surrounding it, which all indicate a deliberate act to escape payment of duty. A mere omission, or non-disclosure arising from a bona fide belief that the levy did not apply, is not suppression. Where the issue involves genuine interpretational doubt, the extended period cannot be invoked.
Practical effect: A Chennai business facing a Section 74 demand should argue that any shortfall arose from interpretation, not deliberate concealment, to restrict the demand to the normal period.

The club collected membership subscriptions and admission fees which were spent on meetings, administration and communication, with no facility or benefit supplied to members in return. The Maharashtra Appellate Authority for Advance Ruling held that the collections merely defray shared expenses, that there is no supply of goods or services to members, and that the amounts are therefore not consideration liable to tax.
Why this matters: Chennai associations should note that Section 7(1)(aa), inserted with retrospective effect from 1 July 2017, now treats club to member supplies as taxable, so this reasoning no longer holds.

Where an appellate authority, tribunal or court holds that a notice issued under Section 74 is not sustainable because fraud, wilful misstatement or suppression of facts is not established, Section 75(2) requires the proper officer to re-determine the tax as though the notice had been issued under Section 73. The Board clarified that this re-determination must be completed within two years from the date of communication of that order, and only the normal period demand can survive.
What to do about it: Winning on the suppression point in appeal does not end the matter, but it limits the surviving Chennai demand to the normal period and starts a two-year clock on the department.
