Silver filigree work and handmade imitation jewellery, including jewellery of natural seeds and beads, carry 1.5 per cent central tax, that is three per cent combined.

Practical effect: Handicraft retailers in Chennai charge five per cent on the general run of handicraft goods, but must apply three per cent to silver filigree work and handmade imitation jewellery.

Where a foreign holding company allots its own shares to employees of its Indian subsidiary under an ESOP, ESPP or RSU plan and the Indian subsidiary reimburses the cost on a cost-to-cost basis, CBIC clarified that the transaction is in securities and is not a supply of goods or services. No GST is therefore payable by the Indian company under reverse charge on that reimbursement. GST applies only if the foreign company charges an additional amount such as a markup or administration fee.

The Council replaced the declared tariff basis for hotel accommodation with actual transaction value and reset the slabs with effect from 1 October 2019: nil where the value is up to Rs 1,000 per day, 12 per cent between Rs 1,001 and Rs 7,500, and 18 per cent above Rs 7,500. Outdoor catering, other than in premises having daily tariff above Rs 7,500, was reduced from 18 per cent with input tax credit to 5 per cent without credit. This substantially reduced tax on mid-segment hotels and on marriage and event catering.

What to do about it: Chennai hotels and outdoor caterers had to rebuild their rate logic around the actual amount charged, and caterers lost input credit in exchange for the lower five per cent rate.

Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
What happens if I ignore a GSTR-3A notice from the GST department?
If the return is not filed within fifteen days, the officer can complete a best judgment assessment under Section 62 and pass an order in Form ASMT-13, estimating your liability from GSTR-1 data, e-way bills and bank information. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Are hospital and clinic charges exempt from GST?
Healthcare services provided by a clinical establishment, an authorised medical practitioner or paramedics are exempt from GST. This covers diagnosis, treatment and care for illness, injury, deformity or pregnancy in any recognised system of medicine in India, and includes transportation of patients by ambulance, which is separately exempt for any provider. Consultation fees, surgery charges, nursing and diagnostic services within this definition carry no GST, which is why hospitals do not charge tax on treatment bills. What documents must I prepare for reverse charge purchases from unregistered suppliers?
Two documents are required.
