Gold, silver, diamonds and jewellery rates left untouched by GST 2.0

Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, Schedules IV, V and VI · 2025-09-17

Schedule IV at 1.5 per cent central tax, that is three per cent combined, covers pearls, silver, gold, platinum, base metals clad with precious metal, articles of jewellery, goldsmiths' and silversmiths' wares, imitation jewellery and coin. Schedule V at 0.125 per cent, that is 0.25 per cent combined, covers rough or simply sawn diamonds and unworked precious and semi-precious stones. Schedule VI at 0.75 per cent, that is 1.5 per cent combined, covers cut and polished diamonds and worked synthetic stones.

Union of India v. Ind-Swift Laboratories Ltd — Supreme Court, (2011) 4 SCC 635, judgment dated 21-02-2011 · 2011-02-21

Interpreting the words credit taken or utilised wrongly, the Supreme Court held that the word or cannot be read as and. Interest becomes payable from the date the wrong credit is taken, without waiting for it to be utilised. The Court declined to rewrite a plain statutory provision. Parliament later amended the law prospectively, and under GST interest on wrongly availed credit generally arises only where the credit is both availed and utilised.

What is the general penalty under Section 125 and when is it imposed?
Section 125 is the residual penalty provision for contraventions of the Act or rules for which no separate penalty is prescribed anywhere else. It can extend to Rs.25,000 under the CGST Act, with a matching penalty under the SGST Act, so the practical exposure is up to Rs.50,000 per contravention. Officers invoke it for procedural lapses such as not displaying the registration certificate, minor documentation errors during transit, or failure to furnish information called for. Because the amount is discretionary, a reasoned reply showing the breach was technical and without revenue loss often brings the figure down substantially.
I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?

Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
At what amount of tax evasion can GST prosecution be launched?
Following the Finance Act 2023 amendments, prosecution under Section 132 is generally launched only where the amount of tax evaded, or input tax credit wrongly availed or utilised, exceeds Rs.2 crore, raised from the earlier Rs.1 crore. The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
What is the difference between DRC-01A and DRC-01 in GST?
DRC-01A is a pre-show-cause intimation. In Part A the officer communicates the tax, interest and penalty he has ascertained and gives you a chance to pay or explain before formal proceedings begin; you can respond through Part B of the same form. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. What happens if I do not reply to an ASMT-10 scrutiny notice?
If no satisfactory explanation is filed within thirty days, or you fail to correct the discrepancies, the officer can escalate the matter to a departmental audit under Section 65, a special audit under Section 66, an inspection under Section 67, or straightaway initiate a demand under Section 73 or Section 74. In practice, unanswered ASMT-10 notices convert into DRC-01A intimations and then show cause notices, where penalties and hearings enter the picture. Replying at the scrutiny stage is the cheapest point to close an issue, because you are only explaining, not yet defending a demand. Do not let the window lapse.
How many days do I get to reply to an ASMT-10 notice?
The reply in Form ASMT-11 must be filed within thirty days of being informed of the discrepancies, or within such further time as the officer permits. If you need more time to gather reconciliations, write to the officer seeking an extension before the deadline instead of staying silent. The thirty days pass quickly because a proper reply needs invoice-level matching of GSTR-1, GSTR-3B, GSTR-2B and your books, so start compiling data the day the notice arrives. What is the penalty for running a business without GST registration?

When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Can you give me a simple GST due-date calendar for my business?
For monthly filers: GSTR-1 by the 11th and GSTR-3B by the 20th of the next month. Under QRMP: optional IFF by the 13th of the next month, PMT-06 payment by the 25th, quarterly GSTR-1 by the 13th and GSTR-3B by the 22nd (Tamil Nadu) after the quarter. Section 170 of the CGST Act prescribes normal rounding to the nearest rupee: where the tax contains a part of a rupee, fifty paise or more is rounded up to one rupee, and less than fifty paise is ignored. The rounding is applied to the tax amount on each invoice, separately for each tax head, so CGST and SGST are each rounded individually rather than rounding only the invoice total. Most billing software handles this automatically, but spreadsheets and manual bills often round the grand total instead, creating one-rupee mismatches that clutter reconciliations across thousands of invoices.
What are the GST rates on gold, silver and diamond jewellery?
The special rates on precious metals were retained in the GST 2.0 restructuring. Gold, silver and articles of jewellery attract 3 percent GST, rough and unworked diamonds attract 0.25 percent, and jewellery making charges billed separately attract 5 percent. When a jeweller bills a customer, the metal value and making charges can appear as separate line items with their respective rates on the same tax invoice.
