Recovery stayed for taxpayers awaiting the GST Appellate Tribunal

Circular No. 224/18/2024-GST · 2024-07-11

Because the GST Appellate Tribunal was not yet operational, CBIC directed that taxpayers who lost their first appeal could pay the additional pre-deposit required for a Tribunal appeal through the electronic liability register and file an undertaking to appeal once the Tribunal starts functioning. On doing so, recovery of the balance confirmed demand stands stayed under Section 112(9). Officers were told not to coerce full payment merely because the appellate forum was unavailable.

Practical effect: After an unfavourable first-appeal order, paying the ten per cent Tribunal pre-deposit with an undertaking legally halts recovery until GSTAT hears the case.

Late fee waived for GSTR-3B of the second COVID wave months

Notification No. 09/2021-Central Tax · 2021-05-01

The late fee under Section 47 for GSTR-3B was waived for the March and April 2021 tax periods, later extended to May 2021, for a specified number of days beyond the due date. Taxpayers with turnover above Rs 5 crore received a fifteen-day waiver while smaller taxpayers received thirty days, with a corresponding waiver for quarterly filers of the January to March 2021 quarter. Beyond the waived window the ordinary late fee applied from the original due date.

An assessment order for 2019-20 alleged wrongful availment of input tax credit, and the taxpayer's rectification petition, which annexed a detailed reconciliation between GSTR-2A and GSTR-3B, was simply left undecided by the department. The Madras High Court recorded that the reconciliation had been furnished and directed the officer to consider and dispose of the rectification petition dated 12 March 2024 by a speaking order, after affording a reasonable opportunity to the taxpayer, within one month.

What to do about it: If you have filed a rectification application with a proper 2A versus 3B reconciliation and heard nothing, the department can be compelled to pass a reasoned order.

As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts.
