Maharashtra State Power Generation Co Ltd — AAR Maharashtra, Order No. GST-ARA-15/2017/B-30, dated 8 May 2018 (upheld by AAAR) · 2018-05-08
The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
What to do about it: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.
Tvl. Kavin HP Gas Gramin Vitrak v. Commissioner of Commercial Taxes — Madras High Court, 2023 (affirmed in writ appeal, 2025) · 2023-11-24
A gas distributor's input tax credit for early GST years was rejected as time-barred because it was not claimed through returns in time. The Madras High Court noted that the statutory GSTR-2 mechanism for claiming credit was never operationalised on the portal, and held that a taxpayer cannot be deprived of substantive credit for the failure of the system, permitting the belated claim to be examined on merits with supporting evidence rather than being rejected mechanically on limitation.
What it means for you: Where portal limitations blocked a legitimate credit claim, this precedent supports a merits-based examination — document the system failure and your underlying eligibility thoroughly.
Notification No. 10/2017-Central Tax dated 28.06.2017 · 2017-06-28
This notification amended the CGST Rules, 2017 as originally notified under Notification 03/2017-Central Tax, adding the substantive operating chapters that had been left out of the first tranche.
