Composition taxpayers who left Table 6 of the annual return GSTR-4 blank found that the tax already paid through Form CMP-08 was treated as an excess payment, creating a negative liability that was then adjusted against later quarters. GSTN clarified that outward supply and reverse charge figures must be entered in Table 6 even though the tax has already been paid, and arranged for wrongly created negative balances to be reversed.

What to do about it: Composition dealers in Chennai must complete Table 6 of GSTR-4 each year, or the portal will show a false credit and later recover it.

No section 73(11) penalty for merely paying self-assessed tax late

Circular No. 76/50/2018-GST dated 31 December 2018 · 2018-12-31

This circular answered a set of unrelated questions. The most important is that the penalty under section 73(11) does not apply where self-assessed tax shown in the return is paid late; only interest under section 50 and, where warranted, general penalty under section 125 arise. It also dealt with the rate applicable to notes issued under section 142(2) and who is the owner of goods in transit. A corrigendum of 7 March 2019 clarified that tax collected at source under the Income-tax Act is not included in the taxable value.

What it means for you: If a demand adds a heavy penalty simply because GSTR-3B tax was paid late, this circular is the answer.

You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. Such invoices must be reported individually in Table 5 of GSTR-1 with the place of supply, instead of being merged into the consolidated B2C summary. The rule helps states track high-value consumer sales flowing across borders. I make both taxable and exempt supplies. How is the Rule 42 credit reversal actually computed?
Rule 42 first removes credit exclusively for exempt supplies and non-business use, and credit exclusively for taxable supplies, leaving the common credit. From this common pool, you reverse the portion equal to exempt turnover divided by total turnover for the month, plus a flat five percent of the common credit where inputs are partly used for non-business purposes. The reversal is declared monthly in GSTR-3B, and a final recomputation for the whole year must be done, with any shortfall paid with interest, by the November return following the financial year. Only in defined situations. From 18 July 2022, renting of a residential dwelling to a registered person attracts 18 percent under reverse charge in the tenant's hands. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense.
