Supreme Court applies the doctrine of mutuality to exempt clubs supplying members

The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.

What to do about it: Chennai clubs, associations and resident welfare bodies cannot rely on mutuality under GST any longer, as the law was amended to override this ruling.

The Council recommended reducing the GST rate from 28 to 18 per cent on goods falling in 178 headings at the four-digit level, including four headings only partially pruned, so that the 28 per cent list fell from 224 tariff headings to only about 50. Further reductions were recommended from 28 to 12 per cent, from 18 to 12 per cent and from 18 to 5 per cent on specified goods, together with relief for the aviation and handicraft sectors and restaurants.

Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. Do I have to pay GST on my Adobe, Canva or AWS subscriptions billed from abroad?
If you are GST-registered and the foreign supplier has not charged Indian GST, yes. Services received from a supplier located outside India for business purposes are an import of services, taxable in your hands under reverse charge at 18 percent. If you do not file by the due date, the return is deemed furnished.
