The Supreme Court held that where a developer enters into an agreement with a buyer before construction is completed, the construction carried out thereafter is executed for the buyer and constitutes a works contract liable to tax. Tax can be levied only on the value of goods incorporated after the agreement date, and the value of land must be excluded. The applicant promoted courses of foreign universities in India and recruited students for them, receiving commission in foreign exchange. It claimed the service was an export and therefore zero rated. The West Bengal Authority for Advance Ruling, affirmed on appeal, held that the applicant merely facilitates admission of students to the university and is an intermediary under Section 2(13) of the IGST Act. As the place of supply of an intermediary is the location of the supplier, the service is a domestic supply liable to GST.

46th GST Council Meeting, New Delhi — 31 December 2021 · 2021-12-31
The 46th meeting was convened on the last day of 2021 with essentially one outcome. The Council recommended deferring the decision to change the rates in textiles that had been recommended at the 45th meeting, so that the existing rates in the textile sector would continue beyond 1 January 2022. The reversal came after sustained representations from textile states and the trade that the increase from 5 to 12 per cent would raise costs for consumers and unorganised weavers. The footwear rate increase, however, went ahead as planned.
What it means for you: Textile traders in Chennai and across Tamil Nadu continued at five per cent from January 2022, but footwear moved to twelve per cent, so the two sectors diverged from that date.
