Rule 37A makes the buyer responsible where a supplier declares an invoice in GSTR-1 but fails to file the corresponding GSTR-3B by 30 September following the end of that financial year. The recipient must reverse the input tax credit availed on that invoice by 30 November of that year, failing which interest under Section 50 runs. If the supplier later files the return and pays tax, the recipient may re-avail the credit without any time limit.

Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.
Practical effect: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.
Mr. Kannippan Arumugan v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 2943 of 2026, decided 30 January 2026 (C. Saravanan J.) · 2026-01-30
The taxpayer had reported tax of Rs 2,54,040.30 against an invoice instead of the correct Rs 1,31,280.30, and a demand followed. The Court quashed the assessment order dated 21 July 2025 and remitted the matter for fresh adjudication within six months, permitting the petitioner to rectify the inadvertent error subject to compliance with Circular No. 212/6/2024-GST, and directing the officer to verify with the recipient's jurisdiction whether excess credit had in fact been availed.
Practical effect: A clerical overstatement in GSTR-1 by a Chennai supplier can still be corrected long afterwards, provided the recipient has not taken the excess credit and the Circular 212 procedure is followed.
