The Supreme Court held that the doctrine of mutuality survived the Forty-sixth Constitutional Amendment. Supplies of food, drink and services by an incorporated members' club to its own members are not a sale or a service to another person, so sales tax and service tax could not be levied. Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.

Why this matters: Chennai clubs, associations and resident welfare bodies cannot rely on mutuality under GST any longer, as the law was amended to override this ruling.

GST on fertilisers cut to five per cent on the eve of rollout

Meeting on the day GST was launched, the Council revisited the rate on fertilisers. Officers calculated the pre-GST incidence at about 9.75 per cent, placing fertilisers between the five and twelve per cent slabs. After almost every State supported relief for farmers, the Chairperson recorded a consensus and the Council agreed to tax fertilisers at five per cent instead of twelve, notwithstanding the inverted duty refund burden this would create for manufacturers whose inputs were taxed at eighteen per cent.

Why this matters: The Council reopened a rate it had already fixed only weeks earlier, and the cut created the inverted duty structure that fertiliser dealers still claim refunds under.

GSTN first advised that from the April 2025 period, auto-populated values in Table 3.2 of GSTR-3B, covering inter-state supplies to unregistered persons, composition taxpayers and UIN holders, would become non-editable, with corrections routed through GSTR-1A. After taxpayer representations, a 16 May 2025 advisory kept Table 3.2 editable for the time being. The locking was later subsumed in the broader hard-locking of GSTR-3B liability during 2025.

What is a B2C large invoice and what is the current threshold?
A B2C large invoice is an inter-state supply to an unregistered person exceeding the notified value threshold, which was reduced from Rs.2.5 lakh to Rs.1 lakh. Such invoices must be reported individually in Table 5 of GSTR-1 with the place of supply, instead of being merged into the consolidated B2C summary. The rule helps states track high-value consumer sales flowing across borders. If your Agaram showroom occasionally bills an unregistered customer from another state above Rs.1 lakh, your billing and returns process must flag it for invoice-wise reporting, or GSTR-1 validations and later scrutiny will surface the gap.
Can I issue a single credit note against several invoices?
Yes. My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. Retailers with seasonal return spikes benefit most from this facility.
My shop was closed for a month. Can I skip filing GST returns for that period?
No. Once you hold an active GSTIN, returns must be filed for every tax period regardless of business activity. If there were no sales and no purchases, you must file nil GSTR-1 and nil GSTR-3B for that month. Skipping creates a break in the sequential filing chain, blocks future returns, accumulates late fees and can eventually lead to suspension of registration. I am selling old machinery on which ITC was claimed. Do I have to pay anything back?
Yes. Failure to file nil returns attracts a late fee of Rs.20 per day per return, capped at Rs.500 per return, and breaks the sequential filing chain. I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B. By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Agaram godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. Event managers and contractors see cancellations regularly, and using the wrong document between these two is a common reconciliation error.
Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months). During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues.
