The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.

Inadvertent overstatement in GSTR-1 allowed to be corrected following Circular 212 of 2024

Mr. Kannippan Arumugan v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 2943 of 2026, decided 30 January 2026 (C. Saravanan J.) · 2026-01-30

The taxpayer had reported tax of Rs 2,54,040.30 against an invoice instead of the correct Rs 1,31,280.30, and a demand followed. The Court quashed the assessment order dated 21 July 2025 and remitted the matter for fresh adjudication within six months, permitting the petitioner to rectify the inadvertent error subject to compliance with Circular No. 212/6/2024-GST, and directing the officer to verify with the recipient's jurisdiction whether excess credit had in fact been availed.

Small petrol cars up to 1200 cc and up to 4000 mm, small diesel cars up to 1500 cc and up to 4000 mm and motorcycles up to 350 cc moved to eighteen per cent, while larger cars, hybrids above those limits and motorcycles above 350 cc were placed at forty per cent.

Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
How is interest calculated if I pay GST late?
Interest is charged at 18 percent per annum under Section 50 of the CGST Act, calculated day-wise from the due date until the date of payment. Following the amendment to Section 50, interest on delayed GSTR-3B filing applies only on the portion of tax paid through the electronic cash ledger, not on the amount settled using input tax credit. For example, a cash liability of Rs.1,00,000 paid 30 days late attracts roughly Rs.1,479 as interest. We compute this precisely before filing so clients in Agaram never overpay or underpay.
Do I get ITC on machinery purchase in one shot or in instalments over years?
In one shot.
