The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.
What to do about it: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.

As originally notified, Entry 12 exempted renting of a residential dwelling for use as residence, without any condition about who the tenant was. From 1 July 2017 to 17 July 2022 a house or flat let out for residential use carried no GST, whether the tenant was an individual, a firm or a company. The entry was narrowed with effect from 18 July 2022 so that the exemption no longer applies where the tenant is a registered person.
What it means for you: For rent periods up to 17 July 2022 a Chennai landlord had no GST liability on residential letting, which is a useful defence if an old notice questions those years.

CBIC clarified that the words subsequently held in section 77 of the CGST Act and section 19 of the IGST Act cover both a case where the department holds a supply to be inter-State or intra-State and a case where the taxpayer himself realises the error, provided the correct tax is then paid. Under rule 89(1A), the refund of the wrongly paid tax must be claimed within two years of paying tax under the correct head, and for payments made before 24 September 2021 the period runs from that date.
What it means for you: If you have paid CGST and SGST on what was actually an inter-State supply, pay the IGST first and then claim the refund within two years, with no interest liability under section 77.
