The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.
Practical effect: The borrowings arranged here are why compensation cess continued to be collected on cess goods long after the five-year compensation period ended in June 2022.
Notification No. 8/2021-Central Tax (Rate), dated 30 September 2021 · 2021-09-30
Acting on the 45th GST Council recommendation, the Government raised the rate on solar power based devices, solar generators, photovoltaic cells and modules, wind operated electricity generators, biogas plants and waste-to-energy devices from five per cent to twelve per cent with effect from 1 October 2021. Combined with the 70:30 deeming rule, this pushed up the delivered cost of rooftop and utility scale solar projects and prompted a wave of contract repricing and change-of-rate disputes under Section 14.
Practical effect: Projects straddling 1 October 2021 must fix the rate using the time-of-supply rules in Section 14, since invoice date, payment date and supply date can point to different rates.
Circular No. 179/11/2022-GST, dated 3 August 2022 · 2022-08-03
Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.
Why this matters: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.
